3. Restriction on importation, sale and distribution
(1) No person shall import, sell or distribute any tobacco product in Kenya unless the
package containing the product displays the warning set out in the First Schedule.
(2) The warning referred to in subrule (1) shall—
(a) be in both the English and Kiswahili languages;
(b) be clearly and prominently printed on all the packages of the tobacco
product comprising not less than 50% of the total surface area of the
package, parallel to the top edge of the package and located on the upper
portion of the front and rear panels of the package directly on the package
underneath the cellophane or other clear wrapping;
(c) be displayed on a principal display surface in a manner that ensures that
none of the words of the warning will be severed when the package is
opened;
(d) bear text that is black on a white background or white on a black
background in a manner that contrasts by typography, layout or colour with
all other printed material on the package.

43. Incorrect statements
(1) Notwithstanding section 42(2) to (4), if in the case of any goods required under this Act to have associated with them a document containing particular statements, that document is found to contain any such statement which is materially incorrect, any person who, knowing or having reasonable cause to suspect that statement to be materially incorrect, inserted it or caused it to be inserted in the document, or used the document for the purposes of this Act while that statement was contained in the document, shall be guilty of an offence.
(2) Subsection (2) of section 40 shall have effect for the purposes of this section as it has effect for the purposes of that section.

6. Unless otherwise provided under this Act, or any
other written law-
(a) goods which are taken out from any part of the customs territory and brought into the special economic zone or services provided from part of the customs territory to a special economic zone shall be deemed to have been exported from Kenya;and
(b) goods which are brought out of a special economic zone and taken into any part of the customs territory for use therein or services provided from a special economic zone to any part of the customs territory shall be deemed to be imported into Kenya.
7. Subject to section 6—
(a) goods and services within a special economic zone, which shall constitute a customs controlled area, shall not be taken out of the zone except —
(i) for export;
(ii)for entry into the customs territory, subject o the regulations and procedures on customs;
(iii)for removal to any other customs controlled area with the approval of the proper officers, and subject to any conditions as may be imposed; or
(iv) for repair and maintenance or processing or conversion with prior approval of the proper officer and subject to any conditions as may be imposed;
(b) where goods are manufactured outside Kenya, such goods shall be clearly labelled as products of the country where such goods were manufactured;
(c) services provided by a special economic zone enterprise may be provided to-
(i)persons outside Kenya

9. Deception
Any person who labels, packages, treats, processes, sells or advertises any drug in contravention of any regulations made under this Act, or in a manner that is false, misleading or deceptive as regards its character, constitution, value, potency, quality, composition, merit or safety, shall be guilty of an offence.
10. Standards of drugs
(1) Where a standard has been prescribed for a drug, any person who labels, packages, sells or advertises any substance in such a manner that it is likely to be mistaken for that drug shall be guilty of an offence unless the substance is the drug in question and complies with the prescribed standard.
(2) Where a standard has not been prescribed for a drug but a standard for the drug is contained in any of the publications specified in the Schedule, any person who labels, packages, sells or advertises any other substance or article in such a manner that it is likely to be mistaken for such drug shall be guilty of an offence.
(3) Any person who labels, packages, sells or advertises any drug for which no standard has been prescribed, or for which no standard is contained in any of the publications specified in the Schedule, shall be guilty of an offence unless such drug—
(a) is in accordance with the professed standard under which it is labelled, packaged, sold or advertised; and
(b) does not resemble, in a manner likely to deceive, any drug for which a standard has been prescribed or which is contained in any of the publications specified in the Schedule.

Description of the measure: 20. Packaging and labelling
(1) Subject to subsection (2), no person shall supply a dangerous drug otherwise than in a container labelled -
(a) in the case of a powder, solution or ointment, with the total quantity of the dangerous drug supplied and the percentage of the dangerous drug contained in it;
(b) in the case of tablets and other articles, with the total quantity of the dangerous drug contained in the tablet or article;
(c) in the case of substances and preparations listed in Schedule II, a double red band.
(2) Subsection (1) shall not apply to a dangerous drug dispensed by, or on the prescription of, a medical practitioner, dental surgeon or veterinary surgeon.
(3) The outer wrapping of parcels for consignment containing dangerous drugs shall bear no information other than the names and addresses of the sender and the consignee and shall be sealed with the sender's mark.

Description of the measure
3. (1) No trader shall import a commodity for sale in Mauritius unless at the time of its importation –
(a) the commodity bears a conspicuous label indicating the country of origin of the commodity; or
(b) where the nature of the commodity is such that it does not permit compliance with subparagraph (a), the container of the commodity bears a conspicuous label indicating the country of origin of the commodity.
(2) Where a trader imports a commodity for sale in Mauritius for further processing or for repacking, he shall put a conspicuous label –
(a) on the finished commodity or on the commodity which has been repacked; or
(b) where the nature of the commodity is such that it does not permit compliance with subparagraph (a), on the container of the commodity.
(3) The label required by paragraph (2) shall indicate –
(a) the country of origin of the imported commodity and its mark, if any, and
(b) that the final process of manufacture of the imported commodity has taken place in Mauritius.
