Description of the measure
9. (2) Without derogation from the generality of the provisions of subsection (1), the Minister may in regulations, orders or notices made in terms of that subsection-
(j) provide for the production of certificates signed by responsible persons or authorities in the country or territory of origin relating generally or specifically to-
(i) the freedom of imported growing media, invertebrates and plants or the area in which they were produced or grown from injurious organisms

Description of the measure
5. (2) No person shall introduce or cause to be introduced into Zambia any article specified in the Fourth Schedule without a certificate from a Veterinary Officer of the country from which the article originates, stating that there has been no case of East Coast fever in the district of origin during the two years immediately preceding the issue of such certificate and no foot and mouth disease nor African swine fever in the district of origin during the six months immediately preceding the issue of such certificate and that, in his opinion, the movement of the article is free from risk of spreading any disease.
(3) No person shall introduce or cause to be introduced into Zambia any articles pecified in the Fifth Schedule without a certificate from a Veterinary Officer of the country from which the article originates, stating that there has been no foot and mouth disease nor African swine fever in the district of origin during the six months immediately preceding the issue of such certificate.

Description of the measure
41. (1) An automatic measuring instrument shall be—
(a) certify by the Superintendent Assizer in terms of section fifteen of the Act;
(b) securely fixed in position in which it will operate;
(c) tested in situ with the liquid it is intended to measure;
(d) be fitted with seals to protect all adjusting devices or have all such devices operate only with a special detachable key;
(e) marked with clear marks of identification on all parts that require to be dismantled for any purposes whatsoever, such marks to give a clear indication of the matching parts which are to be matched on re-assembly;
(f) tested at various heads and rates of delivery where these are not uniform;
(g) tested by taking not less than twenty samples either at random or in sequence; and
(h) marked with a stamp of assize upon a lead plug on conspicuous part of the instrument or on the main body of the machine.
(2) The limit of error allowed on an automatic measuring instrument shall be—
(a) the maximum error in excess or deficiency of the amount to be delivered into the container of 0.1 percent; or 0.05% in deficiency;
(b) such that the average error of a sample of twenty or more deliveries does not exceed 0.1 % in deficiency

Description of the measure: 3 (1) Notwithstanding the provisions of any other law, but subject to the provisions of this section , no person shall-
(a) Import into or export from Zimbabwe any wild life, trophy or controlled goods except in accordance with the terms and conditions of –
(i) An open general permit; or
(ii) Permit; or
(iii) a certificate issues in terms of section 5 ; and where appropriate in accordance with the terms and conditions of an open general licence or licence issued in terms of Control of goods (Import and Export) (Commerce) Regulations , 1974 published in the Rhodesia Government Notice 766 of 1974; or

(2). The provisions of subsection (1) shall not apply to the import or export of –
(a) any wild life or trophy which was acquitted by the importer or exporter before the convention applied to it, if the importer or the exporter hold the certificate to that effect –
(i) in the case of import granted by an appropriate authority in the country from which the wild life or trophy concerned is being imported ; or
(i) in the case of an export, issued by the Director ; or
(b) any wildlife which was bred in captivity, ranched artificially propagated as the case may be, or any trophy of such wild life , if the importer or the exporter holds the certificate to that effect –
(i) in the case of an import , granted by an appropriate authority in the country in which the wild life concerned was bred or propagated :or
(ii)in the case of an export, issued by the Director,
Or
(c)herbarium specimens, other preserved, dried or embedded museum specimens , or plants material ,
Where-
(i)their import or export is effected by-
A. a museum which is a national museum for the purposes of the National Museum and Monuments Act [Chapter 313];
B. any other museum approved by the Director ; and
C. any scientist approved by the Director ; and
(ii) the specimens and material carry a label issued or approved by the Director
(3) No permit or certificate shall be required in terms of sub section (1) for the import or export of any wild life or trophy
(a) which a personal or household effect, save in the following cases-
(a) where a person who is ordinarily resident in Zimbabwe imports into Zimbabwe any wild life referred to in Part I of the Second Schedule , or any trophy of such wild life , which he acquired outside Zimbabwe ; or
(b) where a person who is ordinarily resident in Zimbabwe imports into Zimbabwe wild life referred to in Part II of the Second Schedule , or any trophy of such wild life, which he acquires outside Zimbabwe in the country where the wild life was removed from the wild , if that country requires the prior grant of an export permit before any export of such wild life or trophy ; or
c) where a person who is not ordinarily resident in Zimbabwe exports from Zimbabwe any wild life referred to in Part I of the Second Schedule or any trophy of such wild life which he acquires within Zimbabwe ; or
(d) where a person who is not ordinarily resident in Zimbabwe exports from Zimbabwe any wildlife referred to in Part II of the schedule which was removed from the wild within Zimbabwe, or any trophy of such of such wild life , if he acquired such wild life or trophy within Zimbabwe
5(1) Subject to the provisions, of this , the Director may issue to any person-
(a) a permit authorizing , subject to the provisions of any other law, the import into Zimbabwe of any controlled goods , wild life or trophy ;
(b) a certificate authorizing , subject to the provisions of any other law , the import into Zimbabwe of any wild life referred to in Part I or II of the Second Schedule, or any trophy of such wild life which has been taken from a marine environment which is not under the jurisdiction of any State;
(c) a certificate authorizing , subject to the provision of any other law , the re-export from Zimbabwe of such wild life referred to in Part I, II or III of the Second Schedule, or any trophy of such wild life, where such wild life or trophy as previously been imported into Zimbabwe in terms of regulations ; as may be appropriate in the particular case.
(5) No certificate referred to in paragraph(b) of subsection (1) shall be issued in terms of subsection (1)or (2) for the import into Zimbabwe of any wild life, or trophy of any wild life, which has been taken from a marine environment not under the jurisdiction of any State, unless-
(a) in the case of such wild life referred to in Part I of the Second Schedule , or a trophy of such wild life-
(i) the Director is satisfied , or in the case of a certificate issued by the Controller, the Director has certified to the Controller, that
A. the import will not be detrimental to the survival of the species of wild life concerned and
B. the wild life or trophy will not be used for primarily commercial purposes; and
(ii) in the case of an import of a live specimen of such wild life , the Director is satisfied that the proposed recipient is suitably equipped to house and care for it;
(b) in the case of such wild life referred to in Part II of the Second Schedule, or a trophy of such wild life –
(i) the Director is satisfied , or in the case of a certificate issued by a Controller , the Director has certified to the Controller, that the import will not be detrimental to the survival of the species of wild life concerned ; and
(ii) in the case of an import of a live specimen of such wild life, the Director is satisfied that the wildlife will not be handled as to minimize the risk of injury, damage to health or cruel treatment.
6. No certificate referred to in paragraph c) of subsection (1) shall be issued in terms of subsection (1) or (2) for the re-export from Zimbabwe of –
(a) any wild life referred to in Part I of the Second Schedule , or any trophy of such wild life , unless-
(i) the Director or Controller , as the case may be, is satisfied that-
A. an import permit has been, or will be granted in respect of the wild life or trophy concerned by an appropriate authority in the country to which the wild life or trophy concerned is being re-exported , and
B. the wild life or trophy concerned was imported into Zimbabwe in accordance with the provisions of the Convention; and
(ii) in the case of a re-export of a live specimen of such wild life, the Director is satisfied that the wild life concerned will be so prepared and shipped as to minimize the risk of injury , damage to health or cruel treatment
(b) any wild life referred to in Part II of the Second Schedule or any trophy of such wild life unless –
(i) the Director or Controller , as the case may be is satisfied that the wild life or trophy concerned was imported into Zimbabwe in accordance with the provisions of the Convention; and
(ii) in the case of a re-export of a live specimen of such wild life, the Director is satisfied that the wild life concerned will be also prepared and shipped as to minimize\e the risk of injury , damage to health or cruel treatment.
(8) No permit or certificate issued in terms of subsection (1) or (2) shall authorize the import, export or re- export, as the case may be , of more than one consignment of wild life or trophies.

Description of the measure: 4 (1) Subject to these regulations, any food imported into or exported from Zimbabwe shall be subject to inspection, analysis and, where necessary, to detention, disposal or destruction in terms of the Act at any port of entry into or out of Zimbabwe unless the importer or exporter holds a Food Sanitary Certificate issued in respect of the food concerned. A Food Sanitary Certificate is issued in accordance with procedure outlined in the Food and Food Standards (Inspection and Certification) Regulations, 2015.
(2) A Pre-shipment inspection shall ensure that any food intended for importation or exportation is in compliance with the Act or any relevant regulations made in terms of the Act or any other enactment.
(3) Where any food is not specifically covered by the Act, or any regulations, provisions of the CODEX relevant to the food concerned may apply.
(4) Where an importer or exporter fails to produce a Food Sanitary Certificate, the food shall be subject to inspection and analysis in terms of the Act and for that purpose, shall be detained at the port of entry, a designated warehouse or as may otherwise be directed by the competent authority at the said port pending the inspection and analysis.

(6) The cost of inspection, analysis and detention of any food shall be borne by the importer or exporter as the case may be.
(7) Detained food shall not be disposed of in any way or removed from detention except on the written authority of an inspector or an order of a competent court in Zimbabwe.

5. Where an exporter has the prior approval of the competent authority of the importing country for the export of any specified food without a Food Sanitary Certificate, the requirements of section 4 may be waived

6. A Food Sanitary Certificate shall not exempt an exporter or importer from complying with any other preshipment veterinary, biotechnological, plant quarantine, phytosanitary and GMO requirement under the law.

7. (1) Where Zimbabwe has an equivalence agreement with any country, a certificate equivalent to a Food Sanitary Certificate issued by a competent authority of any such county may be accepted at a port of entry and a pre-shipment inspection may, unless specifically demanded by a competent authority on goods cause shown, not be required.
(2) A competent authority in Zimbabwe may seek verification of any certificate equivalent to a Food Sanitary Certificate issued by a competent authority to a Food Sanitary Certificate issued by a competent authority of any country.

11. Powers of entry
( 1) A departmental officer may enter on any land, building, shed, place, carriage, van, truck, vessel or aircraft containing or conveying or used for conveying animals for the purpose of inspecting or examining any stock, carcass, article or vehicle to ascertain whether or not the provisions of this Act are being properly carried out.

(1) Any person who imports any plant, plant product or regulated article shall immediately declare the item and deliver it to a plant inspector or other representative of the NPPO.
(2) A plant inspector or representative of the NPPO, upon receipt of an item in terms of subsection (1) may-
(a) examine the plant and its container as well as any required accompanying documentation;
(b) if the presence of any regulated pest thereon is established or reasonably suspected, cause the same to be treated at the expense of the importer; and
(c) if he or she considers that any measures taken or to be taken under paragraph (b) are, or are likely to be, ineffective and he or she considers the pest to have the potential to cause an unacceptable impact on the plant resources of Botswana, or if the imported articles are not accompanied by the required documentation, cause the imported articles to be re-exported or destroyed.
(3) Inspections under this section shall be carried out during regular business hours, except where the plants, plant products or other regulated articles are in transit or extremely perishable or where their entry has otherwise been delayed, in which case, upon application by the importer and upon payment of any prescribed fee, the NPPO may agree to an inspection being carried out at any other time.

31.(1) The Authority shall establish and enforce standards in grading, sampling and inspections, tests and analysis, specifications, units of measurement, code of practice and packaging, preservation, conservation and environmental sustainability and transportation of coffee.

32. (1) The Authority may appoint inspectors to conduct independent inspection of a grower’s farm, a mill warehouse or the premises of a coffee trader to ascertain whether the requirements of the Act and these regulations are being complied with.
(2) In carrying out an inspection under subregulation (1) the inspectors shall—
(a) monitor activities along the value chain of coffee to ensure compliance with set regulations and standards;
(b) undertake inspections to ensure compliance with these regulations;
(c) ensure that all people dealing with coffee adhere to the conditions of registration and licensing set out in the Second Schedule.
(3) An inspector shall work in collaboration with the County executive committee member for agriculture of the respective county in the discharge of functions under this regulation.

134. Rules for protection of food
The Minister, on the advice of the board, may make rules regarding all or any
of the following matters—
(g) the inspection and examination of, and the regulation, inspection
and supervision of the manufacture, preparation, storage, keeping
and transmission of, any article of food intended for sale or for
export, and the prohibition of the manufacture, preparation storage,

5. All birds imported from overseas shall be subjected to examination on board ship by an inspecting officer at the time of importation, and no birds shall be moved from the place appointed for examination by the inspecting officer except with the written consent of that officer.
6.The inspecting officer shall satisfy himself, after due inquiry, that the birds imported have not during the voyage either been in contact with any animal which would be likely to spread disease or been exposed to any other infection.
7. The importer shall satisfy the inspecting officer that no fodder or foodstuff likely to cause disease have been taken on board and have been in contact with the birds imported, and no fodder, foodstuffs or equipment shall be landed from the ship except such as are approved by the inspecting officer acting in accordance with instructions from the Director.

Description of the measure
5.All plants, seed and fruit, other than canned or bottled fruits imported, shall be examined by an inspector:
Provided that, in the case of any plant, seed or fruit specified in the Third Schedule, the inspector may, if he is satisfied that such plant, seed or fruit is being imported for consumption, processing, manufacture or any purpose other than propagation, dispense with inspection, and thereupon, notwithstanding the provisions of paragraph 2, no permit shall be required for importation.
6.The inspector may—
(a) direct, authorize or carry out the disinfection or treatment of any plant and of any article believed by him to be infected or infested with or in any way carrying a pest or disease, or likely to infect any plant with a pest or`
b) direct, authorize or carry out the immediate destruction of any imported plant or article which on inspection appears to be infected or infested with or in any way carrying any pest or disease where, in the opinion of an inspector, disinfection or treatment is impracticable or will not be a complete safeguard, or the delay caused by disinfection or treatment would give rise to the risk of the introduction or spread of any pest or disease; and
(c) direct, authorize or carry out the disinfection or fumigation of any vessel, vehicle or aircraft which in the opinion of the inspector is harbouring any pest or disease, or an article likely to infect any plant with a pest or disease.
7.(1) Any package or parcel containing any plant or seed imported otherwise than by post shall be delivered to an inspector by the Commissioner of Customs and Excise.
(2) Any package or parcel containing any plant or seed imported by post shall be delivered to an inspector by the Managing Director of the Kenya Posts and Telecommunications Corporation.
(3) After examination and treatment as provided in sub paragraphs (1) and (2), the package or parcel shall, except where such package, parcel, plant or seed has been destroyed under the instructions of such inspector, be returned by such inspector to the Commissioner of Customs and Excise or the Managing Director of the Kenya Posts and Telecommunications Corporation, as the case may be, for delivery to the addressee.
8.No compensation shall be payable in respect of any package, parcel, article, plant or seed destroyed or damagedin any treatment required to be carried out under this Order.
9.The Director of Agriculture may require imported plants to be detained in quarantine or in special nurseries or places approved by him, for such period as he may think fit.

4. Examination of imported animals
(1) All animals which have been imported shall be moved to a place of quarantine by the inspecting officer for examination in accordance with these Rules, and shall be subject to any special directions or orders (including orders to destruction) as the Director may issue.
(2) Any person who removes an animal from a place of quarantine without the written authority of an inspecting officer, or who fails to comply with any direction or order of the Director issued under paragraph (1), shall be guilty of an offence.

10. Fodder accompanying animals to be free from disease
The importer shall satisfy the inspecting officer that no fodder or foodstuff likely to cause disease or the spread of disease has been taken on board any vessel, aircraft, vehicle or rolling stock and has been in contact with the animal imported; and no such fodder nor foodstuff shall be landed from or reloaded into such vessel, aircraft, vehicle or rolling stock except as approved by the inspecting officer acting in accordance with instructions from the Director

Description of the measure
14(1) The Director or any administrative officer or inspector may enter any land, building, shed, place, carriage, van, truck, motor vehicle, aircraft, boat, or lighter containing or carrying, or having been used for the purpose of containing or carrying—
(i) animals, and may examine the same and any animals found therein for the purpose of ascertaining whether any such animal is infected by a notifiable disease or for the purpose of ascertaining whether the provisions of this Act in respect of the cleansing and disinfection of such building, shed, place, carriage, van, truck, motor vehicle, aircraft,boat or lighter have been properly carried out; and
(ii) meat, carcasses, hides or any article manufactured from the product of any animal, and may examine the same for evidence of notifiable disease or for the purpose of ascertaining whether the provisions of this Act in respect of the cleansing and disinfection of such building, shed, place, carriage, van, truck, motor vehicle, aircraft, boat or lighter have been properly carried out.
(2) Whenever such an inspection is carried out under this section, the owner or occupier of the aforesaid land, building, shed, place, carriage, van, truck, motor vehicle, aircraft, boat or lighter shall render such reasonable assistance as may be required of him by the officer carrying out the inspection. Any owner or occupier who refuses or fails to render such reasonable assistance as may be so required of him shall be guilty of an offence.
